LOS ANGELES – A former California Employment Development Department (EDD) employee has agreed to plead guilty to a federal criminal charge for causing nearly 200 fraudulent COVID-related unemployment relief claims to be filed in other people’s names, resulting in more than $1.6 million in ill-gotten gains, the Justice Department announced today.

          Gabriela Llerenas, a.k.a. “Maria G. Sandoval,” 49, of Perris, signed a plea agreement that was filed today in which she has agreed to plead guilty to a single-count information charging her with mail fraud.

          Court records show that Llerenas previously worked at EDD as a disability insurance program representative. She resigned in March 2002 after admitting to fraudulently authorizing and paying disability benefits administered by EDD. She was sentenced to 37 months in federal prison in connection with that scheme.

          The new scheme that Llerenas has admitted running took advantage of the expanded eligibility for unemployment insurance (UI) benefits made possible by the Coronavirus Aid, Relief, and Economic Security (CARES) Act passed by Congress and signed into law in March 2020. The CARES Act provided additional UI benefits to qualified individuals and helped provide UI benefits during the COVID-19 pandemic to people who did not otherwise qualify, including business owners, self-employed workers, independent contractors, and those with a limited work history.

          From April to October 2020, Llerenas filed and caused the filing with EDD of fraudulent unemployment insurance benefits that falsely asserted the named claimants were self-employed independent contractors – often identifying them as cake decorators or event attendants – who were negatively affected by the COVID-19 pandemic. Llerenas obtained some of the names, Social Security numbers and other identifying information she used to submit the fraudulent claims through her prior work as a tax preparer.

          In her plea agreement, Llerenas also admitted to falsely stating on some of the applications that the claimants were residents of California entitled to unemployment insurance benefits administered by EDD when in fact they lived elsewhere. She also admitted that, on some applications, she inflated the amounts of income she reported for the claimant to maximize the benefit amount. She also admitted to sometimes filing a dozen or more fraudulent EDD claims in a day.

          As a result of the fraudulent unemployment benefits applications that Llerenas filed and caused to be filed, EDD authorized Bank of America to mail debit cards in the names of the claimants to addresses she provided, including her residence, her husband’s business location, her mother’s apartment and the addresses of friends and other family members.

          Llerenas admitted that she charged the named claimants a fee for filling the applications, which was often paid out of the fraudulently obtained benefits. In at least one case, she told the named claimant that she was still employed at EDD and could control the distribution of the unemployment insurance benefits, and then demanded an additional payment for “releasing” the benefits.

          In total, 197 debit cards were fraudulently issued because of this scheme, resulting in losses to EDD and the United States Treasury that Llerenas has admitted were at least $1,633,487.

          Llerenas is scheduled to make her initial appearance on September 22. The criminal offense to which Llerenas has agreed to plead guilty carries a statutory maximum sentence of 20 years in federal prison.

          The Department of Labor-Office of Inspector General, EDD-Investigations Division, Homeland Security Investigations, United States Postal Inspection Service, Federal Bureau of Investigation and Social Security Administration-Office of Inspector General investigated this matter.

          Assistant United States Attorney Ranee A. Katzenstein, Chief of the Major Frauds Section, is prosecuting this case.

          On May 17, 2021, the Attorney General established the COVID-19 Fraud Enforcement Task Force to marshal the resources of the Department of Justice in partnership with agencies across government to enhance efforts to combat and prevent pandemic-related fraud.

          The Task Force bolsters efforts to investigate and prosecute the most culpable domestic and international criminal actors and assists agencies tasked with administering relief programs to prevent fraud by, among other methods, augmenting and incorporating existing coordination mechanisms, identifying resources and techniques to uncover fraudulent actors and their schemes, and sharing and harnessing information and insights gained from prior enforcement efforts. These are instructions to file a new claim (this means you have never filed an unemployment claim, or have not filed a new claim within the last 12 months). If you need to reopen a claim instead, see the Step-by-Step Guide to Reopening a Claim.

Info You Will Need to File a New Claim

  • Your EDD "Benefits Programs Online" account login and password. (If you have never filed before, you will start by creating your account in the next step.)
    • Hopefully you wrote down your account info when you created your account, so it should be a simple matter to log in. (If for some reason you cannot log in and it tells you that your account is locked, you may need to contact the EDD (1-800-300-5616) and try to figure out how to get back in; this may take quite a bit of time).
  • Your gross income for the most recent 18 months, broken down by month, for each employer you worked for.
    • You will need your gross income for each month, starting with July 2019 income. If your December check is issued at the end of December and you are filing before the end of December, you may not have access to your December pay stub, so to estimate what your December gross income wouuld be, simply use your November information.
    • If you taught for multiple intitutions, you will need this info for each employer.
  • Besides the income figures, for each employer, you will need:
    • The number of teaching units you had this semester (or a way to determine your teaching load).
    • The institution's name, address, and phone number.
    • The name and contact number of your immediate supervisor (your dean).
    • The date you first worked for the institution.
    • If you are a member of a union, you will need the union's name, address, phone number, a contact person's name, and the union local number.
  • If you have filed a new claim, or reopened a claim, in the past two years, you will be asked to list the dates you've filed.

California Gov. Gavin Newsom's administration on Thursday announced a major change in how the state pays unemployment benefits, potentially unlocking payments for up to 100,000 people who have gone weeks or months without assistance.

Getting unemployment benefits is a two-step process. First, state officials must decide if people are eligible. If they are, the state starts paying them. But those people must contact the state every two weeks to confirm they are still eligible to keep getting paid.

Sometimes, state officials must investigate residents' eligibility after they have been paid. When this happens, the state stops paying them until the investigation is complete. Before the pandemic, these investigations usually did not take long. But during the pandemic, the state has been overwhelmed with millions of claims that have caused lengthy delays.

The Employment Development Department announced Thursday it would keep paying people unemployment benefits even while they are investigating their eligibility. The change is part of a lawsuit settlement between the state and the Center for Workers' Rights, an advocacy group.

The change applies only to people who have certified for benefits and have already received at least one week of payment in the past. Daniela Urban, the group's executive director, said it could impact up to 100,000 people.

"This is a monumental change by EDD that will allow more claimants to be paid on time," she said.

Unemployment claims skyrocketed across the country during the pandemic, causing backlogs in many states.

Claims have slowed since then, but California still has more than 3 million people receiving some form of unemployment benefits. The state has had a persistent backlog throughout the pandemic.

The change is not without risk for Newsom, who is facing a recall election in September. The governor has been heavily criticized for failing to stop billions of dollars in fraudulent benefit payments to prison inmates  and others who were not eligible to receive them. But he's also faced complaints for a growing backlog of people with legitimate claims who have been unable to get paid because of a complex bureaucracy overwhelmed by the pandemic.

"There's a continuing trade-off between rapid payment of unemployment insurance claims and anti-fraud protocols," said Michael Bernick, a former Employment Development Department director who is now an attorney for the Duane Morris law firm. "This action today in paying continuing claims that have had previous verifications seems to have low fraud risks, while reducing the backlogs."

It's possible this action will cause the state to pay people who are not eligible. In a news release, the Employment Development Department said people who get benefits when they are not eligible could have to pay those back at some point. But it is possible to waive repayment if people claim financial hardship and the overpayment was not the result of fraud.

State Assemblyman Jim Patterson, a Republican from Fresno, said the state's action is a "stunning admission that they can't do their fundamental task" of paying legitimate claims while rooting out fraud.

"Now to clear their giant backlog, they're going to take the dangerous risk of paying fraudsters, too," Patterson said. 

Since March 2020, more than 23 million people have filed unemployment claims in California, and the state has paid $160 billion in benefits. Meanwhile, more than 226,000 people are still waiting for the state to resolve their claims and pay them.

They include 57-year-old Abdulkarim Adam, who lost his job as a bus driver for a private company during the pandemic. The state stopped paying him unemployment benefits in March and never told him why, he said. 

Adam had to borrow money from friends and move in with his sons while he waited. He said he called the state every day but could not get through. He was surprised to later receive a text message from the agency, asking for feedback on their customer service. 

Adam said he replied with a flattering message, hoping that would spur the agency to pay him faster. When that didn't work, he later sent an angry message comparing the agency to the authoritarian dictatorship in North Korea. 

He was relieved on Thursday to finally hear about the state's policy change and hoped it would get him his money faster.

"It will ease a lot of financial difficulties, and it will improve our lives," he said.

The Employment Development Department received more than 5.8 million calls from 421,005 unique callers in the final two weeks of June, according to a report posted on the department's website. The department said it answered 478,749 calls during that period.

Urban said many of those calls were from people like Adam wondering why their benefits were halted. She said fewer of those people will likely call now that they know their benefits won't be interrupted.

"I think it will allow claimants to be more confident in relying on the support of these unemployment benefits, while they still have them, as they look for post-pandemic work," she said.

California EDD makes change to pay unemployment benefits faster: Will you benefit?

Attention Jeffrey B. Feller, Melvin M. Mosby, Patricia Ellis, Laquita Ortiz and dozens of others wherever you are, if you even exist.

That letter you’ve been waiting for from the California Economic Development Department, possibly containing an unemployment benefit payment, was indeed delivered — just not to you.

It’s been sent to Tom and Andrea Gray, a perplexed, retired Rancho Cucamonga couple who can’t figure out why they keep getting mail from the EDD bearing their address and the names of folks they don’t know.

Since June, their mailbox has been flooded with more than 50 such letters.

The Grays feel like they’ve entered the Twilight Zone and fear criminals may be using their address illegally to obtain COVID-19-related relief benefits. They have been dutifully mailing the unopened letters back to the EDD, but new ones keep arriving.

“Why doesn’t it stop?” Andrea Gray, a 74-year-old former nurse, asked in exasperation.

Little help with mail avalanche

The Grays’ mail misery began slowly.

The first week they received only a couple of EDD letters, prompting them to dismiss the mail mix-up as a fluke. But the numbers steadily grew. Eight more letters trickled in over the next three weeks. Then a bunch of 10, followed by the mother lode — 16 letters delivered on a single day this week.

“We have never gotten 16 in one day.” said a dismayed Andrea Gray. “They are multiplying like rabbits.”

Tom Gray, a 77-year-old former molding maker, alerted authorities — county, state and federal — to the couple’s plight, but hasn’t received much help.

First, he took the letters to an EDD office in Rancho Cucamonga, but was turned away because staff there only assists job seekers.

His next stop was the San Bernardino County Sheriff’s Department. “They told me to sit in the lobby,” he recalled. “Then they came back out and said the postmaster general is responsible for running the investigation into EDD fraud.”

Gloria Huerta, a spokeswoman for the San Bernardino County Sheriff’s Department, did not immediately have details regarding the encounter with Tom Gray, but said the referral to the U.S. Postal Service was appropriate. “The post office investigates mail fraud,” she said in an email

After visiting the Sheriff’s Department, Tom Gray gathered up his bundle of mail and headed to a Rancho Cucamonga post office, where he was told by employees to mark the letters as undeliverable and drop them in a mailbox.

He and his wife have been painstakingly doing that ever since, but to no avail.

“We write on the letters that the individuals named don’t live here and send them back,” Andrea Gray said, adding that she refuses to open the letters to see if there is a check or debit card inside, both of which can be used to pay claimants. “I don’t care what’s inside. Either people need the money or it’s a bunch of fraud.”

U.S. Postal Inspection Service officials did not respond to emails and phone calls seeking comment.

Nonexistent recipients

It’s unclear whether any of the individuals whose names appear on the EDD envelopes received by the Grays live in California or even exist.

A public records search for 14 names supplied by the couple found only two matches for possible California residents. Seven names matched individuals who may reside in Texas, Virginia, Pennsylvania and other states, while public records could not be located for the five remaining names.

The Southern California News Group called several individuals whose names match those on the mail received by the Grays, but they either didn’t answer or their phones were disconnected.

Widespread unemployment fraud

Unemployment fraud has been rampant in California since the start of the COVID-19 pandemic in March 2020.

In January, Deputy U.S. Labor Secretary Julie Su said scammers have been paid as much as $31 billion in California unemployment funds. Court dockets are overflowing with cases involving inmates and others who have used fraudulent and stolen identities to receive benefits to which they are not entitled.

EDD officials said Friday in a statement the agency is actively working to stop scammers.

“The EDD is aggressively fighting fraud in the wake of unscrupulous attacks on the unemployment program here in California and across the country,” officials said. “At the EDD, we are dedicated to combating fraudulent activity and protecting benefits for legitimate California workers in need.”

Meanwhile, the Grays can’t figure out why their mail carrier keeps bringing stacks of EDD letters to the home in Rancho Cucamonga’s Alta Loma neighborhood they have owned since 1974. “It’s quite obvious that it’s a single-family dwelling and that we don’t have 16 people living here,” Andrea Gray said with a chuckle. “There’s no more room at the inn.”

Millions of Californians lost work and filed for unemployment since the pandemic began. It's been scary. The worst-unemployment-since-the-Great-Depression kind of scary.

And, like nearly everything else Angelenos are dealing with, the rules for accessing unemployment benefits keep changing.

New programs are being created (and cut and created etc). There have been massive payment delays. And a learning curve. And months of limited-to-no live contact from representatives. And phones that went unanswered. And the waiting, and the waiting, and the waiting, and the waiting.

The process of acquiring and maintaining unemployment benefits can be its own special hell. The system can be absurdly difficult to navigate. And if something goes wrong, or a step gets overlooked, it's been nearly impossible to speak to an actual human person and get it resolved quickly.

So we put together this guide to help people find the steps a little easier, and hopefully minimize some delays in getting paid.

At the end of September, more than 1.5 million Californians were waiting for their unemployment checks. In an effort to improve its processes (and speed up payments, and square the backlog, and reduce fraud) the Employment Development Department stopped accepting new claims for a two-week "reset period" that began in September. Filing was fully operational again, as of Oct. 5.

And, after allowing aid to lapse, President Trump did sign a pandemic relief bill on Dec. 27 which will extend federal unemployment benefits to provide $300 per week. However, because of the timing, processing delays are expected.

California's EDD website has some videos and a detailed FAQ (or two, or three) about how to navigate all of this — but you can also ask us your questions directly.

We've answered thousands of messages from readers since the world turned upside down, and an outsized number have been about unemployment.

Nothing about this process is fast or easy, but whether you're filing for the first time, or troubleshooting an existing claim, let us know what you still need answered.

How (And How Much)

Let's start with the endgame.

The best case scenario is getting $450 per week from the state.

But it might be as low as $40.

Possibly you'll get something in between.

In addition to your state benefits, you're also entitled to an extra $300 per week in federal benefits through the Federal Pandemic Unemployment Compensation (FPUC) program — but only through March 14, 2021.

California has yet to announce when it will start delivering the new federal weekly supplement, but payments will be back dated to Dec 26, 2020. All unemployment recipients should be eligible for this federal add-on.

There's essentially a 3-part process for acquiring unemployment payments: Registering, Filing, Certifying.

  • Registering is setting up an account.
  • Filing is providing personal details and work history.
  • Certifying is checking-in every two weeks to say you're still unemployed/eligible.

Note: certifying is very important. If you do not do it, they will stop sending you money.

You can manage the benefit process online, over the phone, via mail, and even with a fax machine. But the Employment Development Department recommends online, if possible.

Applying For The First Time

  • Go to the Benefit Programs portal on the EDD website.
  • Register for an account / Log in.
  • Select "UI Online."
  • Select "File New Claim"
  • You'll need to provide the following details:
    • Name
    • Address
    • Phone number
    • Social Security number
    • California driver license or ID card
    • Citizenship status
    • Your last employer (name, address, phone number)
    • The last date you worked
    • The reason you're not working there now
    • Your gross earnings from the last week you worked
    • Information about all your employers in the past 18 months (contact details, how long you worked there, gross wages, weekly hours, hourly rate, reason for no longer working there, etc).
    • And, if you are a former federal employee, ex-military, non-citizen, or have a pension, there are additional forms and details to submit.

UI Or PUA

Gesundheit.

The Benefit Programs portal handles claims for both regular state Unemployment Insurance (UI) and the new federal Pandemic Unemployment Assistance (PUA).

Don't panic if you're not sure which one you qualify for. You don't get to choose.

Applicants are asked the same set of history and earnings questions, plus new questions to determine eligibility.

The department then figures out which program fits your situation, and your paperwork will be processed accordingly.

EDD officials now have clarified that you do not need to open a new claim if you had a balance on your existing claim before the CARES benefits ran out.

The Self-Employed

The Pandemic Unemployment Assistance (PUA) program was created to provide financial relief for self-employed people and others who wouldn't typically qualify for unemployment.

That can include:

  • Business owners
  • Self-employed workers
  • Gig workers
  • Freelancers
  • Independent contractors
  • People with a limited work history

And others who qualify.

This modification is being supported by the federal PUA program, which Congress originally created in the spring of 2020 as part of the Coronavirus Aid, Relief, and Economic Security (CARES) Act — and later extended in the winter as part of a new COVID relief bill. These pieces of legislation are sometimes referred to as a stimulus package and/or a coronavirus relief package. The knee bone's connected to the... something.

PUA was originally set to run through Dec. 26, but Congress has now extended it. The program will continue taking new applicants until March 14, 2021. And those already on the program will be able to collect benefits until April 5, 2021, as long as they are still under the 50-week limit.

The $600 Hole

Another provision of the CARES Act, the Pandemic Additional Compensation program, originally provided an additional $600 per week to all unemployment recipients.

However, that benefit dried up at the end of July, and Congress waited until late December to extend the federal add-on.

For a brief period of time, many unemployment recipients received an extra $300 per week under an executive order signed by President Donald Trump. The Lost Wages Assistance (LWA) program meant another $300 per week for those:

  • already receiving at least $100 per week in benefits
  • certifying for unemployment due to COVID-19

Payments for the LWA program were processed starting on September 7, and were backdated to July 26.

Those already partially or fully unemployed due to COVID-19 should have automatically received LWA payments, including retroactive benefits. If that's not the case, you'll need to certify and provide time-sensitive information.

Once all federal supplements went away on September 5, Californians reverted to receiving weekly state benefits based solely on past income or wages:

  • $167 - $450 per week if your claim is processed as PUA.
  • $40 - $450 per week if your claim is processed as UI.

Now, the federal supplement is coming back — but at just half the previous level. All unemployment recipients should be eligible for up to 11 weeks of $300 payments under the new COVID relief bill.

In certain cases, you may be entitled to an extra $100 on top of the $300 supplement. This additional weekly payment is reserved only for people with "mixed incomes" who've found themselves shortchanged by the unemployment system due to a loophole in how benefits are calculated.

Long story short, some freelancers with small amounts of W2 employment income in their recent work history are seeing all of their 1099 self-employment income disregarded by the unemployment system. The result is a benefit amount that's much lower than it should be, had their past income been considered in full. More information on that loophole can be found here.

To qualify for the $100 federal mixed-income supplement, you must have reported at least $5,000 in self-employment income during the most recent tax year — AND have been disqualified from the PUA program covering most freelancers. States must opt in to this relief. Whether or not California will participate remains to be seen. Even if California does sign on, it's currently unclear how EDD will verify your past income for eligibility, or when the department will start delivering the benefit. Stay tuned for further guidance on that.

Reasons For Not Working

They can be health reasons or work reasons.

You can file because of:

  • Termination
  • Cut hours
  • Unpaid leave
  • Furlough
  • COVID-19 quarantine
  • COVID-19 symptoms
  • COVID-19 diagnosis
  • COVID-19 diagnosis in a member of your household
  • COVID-19 diagnosis in a member of your household and you are providing care
  • Having to quit your job as a direct result of COVID-19
  • Your place of employment being closed as a direct result of COVID-19
  • Missing/quitting work to be at home with your kids while schools are closed
  • The job you were about to start isn't available now as a direct result of COVID-19
  • Not being able to reach your place of employment as a direct result of COVID-19
  • The pandemic severely limiting your ability to perform your customary work

And others.

Disability And Paid Family Leave

Or maybe you may want to apply for a different program entirely, like:

EDD manages these too, but they're different programs with different pay structures and timeframes. However, some of the eligibility criteria seem to overlap.

If you do decide to apply and you don't get approved, you can then pivot to file an unemployment claim.

Certifying For Benefits

Now back to unemployment. And filing a claim isn't the end of it. There are still critical steps to take so that payments aren't delayed or denied.

There are plenty of places for things to go wrong during this process, but mistakes are frequently made during the "certification" when people aren't sure how to answer the questions.

Keep these things in mind:

  • You must be well enough to work to receive UI benefits.
  • Benefits are paid according to how many days you're able to work.
  • Benefits are cut one-seventh for each day you can't work due to illness or injury.
  • You must be unemployed through no fault of your own.
  • You must be able and available for work.
  • You must be willing to accept suitable work.
  • You're typically required to look for work, but that's been waived for the time being.

You might be scheduled for a phone interview if there are questions about your paperwork. And EDD says that within two weeks of filing a claim, you'll be getting some mail:

  1. Notice of Unemployment Insurance Claim Filed. This is the overview of the info you provided. You have 10 days from the mailing date to contact EDD if something was processed incorrectly.
  2. Notice of Unemployment Insurance Award. This details your weekly benefit amount and the maximum amount of your claim, based on past wages reported by employers. You have 10 days from the mailing date to contact EDD if something was processed incorrectly.
  3. Employment Development Department Customer Account Number"EDDCAN" is needed for the online portal, and may be used instead of your Social Security number when (if) speaking with the EDD.
  4. Unemployment Insurance Benefits: What You Need to Know. This details the eligibility requirements and reviews the step-by-step process to certifying ongoing benefits.
  5. Continued Claim form. Every two weeks you can certify online via the Benefit Programs portal, or call EDD Tele-CertSM at (866) 333-4606, or mail back this form. Note: Tele-Cert is not available for PUA folks.

How Long Do The Payments Last?

We really want to give you a simple answer, but it's variable.

For PUA, there are up to 46 weeks of available benefits. Those payments can be backdated to February 2, as applicable, and will be available until December 31, 2020.

For UI, you can typically only collect for 26 weeks, but these are not typical times, so now there's something called the Pandemic Emergency Unemployment Compensation (PEUC) which adds another 13 weeks of benefits

And, if you use all your PEUC benefits, you also may qualify for a 20-week FED-ED extension.

If you qualify for either extension it will be applied automatically. PEUC benefits are being handled in phases.

Your Claim Status

Consider this a decoder ring for government-speak.

  • Paid: You met eligibility requirements.
  • Pending:There may be an issue with your certification responses.
  • Disqualified:You are not eligible this week.
  • Excessive Earnings: No benefits because you made more than your weekly benefit amount.
  • False Statement Penalty Week: No benefits this week as a penalty for giving a false statement (for example: you went back to work but didn't tell the EDD and continued to collect benefits).

Good To Know

Here is a medley of timelines, exceptions, best practices, and tips.

  • File your claim the first week you lose your job or have your hours cut.
  • Weeks begin on Sunday.
  • The 7-day waiting period that typically accompanies the first certification has been waived until further notice.
  • Typically, you have to look for work every week to certify. That condition has been waived until further notice.
  • EDD says "it takes at least three weeks to process a claim for unemployment benefits and issue payment to most eligible workers." If you're getting payments on an EDD Debit Card, tack on a few more days for Bank of America to send it to you in the mail (if you had a card but you lost it, replace it here).
  • Use the UI Benefit Calculator for an estimate of what you will receive.
  • You can only file your claim online during certain hours:

In California, the Employment Development Department (EDD) is a department of government that administers the Unemployment Insurance (UI), Disability Insurance (DI), and Paid Family Leave (PFL) programs. The department also provides employment service programs and collects the state's labor market information and employment data. The department is one of California's three major taxation agencies, alongside California Department of Tax and Fee Administration and the Franchise Tax Board; in addition to collecting unemployment insurance taxes, the Department administers the reporting, collection, and enforcement of the state's personal income taxes.[2]

History[edit]

The Legislature created the Department of Employment as part of the Unemployment Reserves Act in 1935. The act (Statutes 1935, chapter 352) was set up to provide "a (monetary) reserve to assist in protecting the public against the social effects of unemployment." The purpose of the department was to operate a statewide system of employment agencies and distribute the payment of unemployment insurance to eligible unemployed workers.[citation needed]

The employment agencies were an existing legacy program launched by the Legislature in 1915 to match unemployed job seekers with employers; they were briefly part of the Department of Industrial Relations (created in 1927) before the Department of Employment was created.[citation needed]

As part of Governor Reagan's Reorganization Plan of 1968, the Department of Employment was placed under the Human Relations Agency. With the signing of chapter 1460 that same year, the department became the Department of Human Resources Development, which assumed the duties, purposes, responsibility, and jurisdiction of the former department. The name of the department was again changed in 1974 (chapter 1212), when it became the Employment Development Department.[3]

Branches[edit]

The Administration Branch provides administrative support to the Department, including providing business operations planning and support services, human resource services for EDD employees, and accounting for the Department's annual budget.[4]

The Disability Insurance Branch has over 1,200 employees organized into a Central Office; a Field Operations Division (with Claims Management Offices and Customer Service Centers); and an Office of the Medical Director.[5] The Branch administers the State Disability Insurance program (which includes Disability Insurance and Paid Family Leave), as well as Non-Industrial Disability Insurance. Among other initiatives, by 2011 the Branch plans to implement a Disability Insurance Automation project for more efficient and effective electronic communications and information processing.[5][6] The state's legal and regulatory requirements for the Branch's programs are found in the California Unemployment Insurance Code, the California Labor Code, and Title 22 of the California Code of Regulations.[7]

The Information Technology Branch is responsible for automation planning, policy, development, maintenance, support, operations, and oversight of automation systems within the Department.[4] The branch provides data processing technical support and services for one of the largest information technology environments in State government, including the planning, development, maintenance, installation, and support of telecommunications systems such as edd unemployment login ca, voice, and data equipment.

The Tax Branch, one of the largest tax collection agencies in the nation, handles all administrative, education, customer service, and enforcement functions for the audit and collection of Unemployment Insurance Tax, Employment Training Tax, State Disability Insurance Tax, and Personal Income Tax withholding.[4] Unemployment Insurance Tax and Employment Training Tax are employer contributions, while State Disability Insurance Tax and Personal Income Tax are withheld from employees' wages.[9] Each year, EDD collects more than $85 billion in payroll taxes, including nearly $71 billion in Personal Income Tax, processes more than 50 million employer payroll tax documents and remittances, and maintains records for more than 19 million workers.[citation needed]

The Workforce Services Branch includes several major programs. The Branch administers the federal Worker Adjustment and Retraining Notification Act (WARN Act) and the California law that expands upon the WARN Act.[10]

Unemployment Insurance (UI) is a federal-state program created to provide partial wage replacement to unemployed workers while they conduct an active search for new work.

The UI program benefits the individual and the local community. For the most part, UI benefits are spent in the local community, which helps sustain the economic well-being of local businesses. California EDD makes change to pay unemployment benefits faster: Will you benefit?

Attention Jeffrey B. Feller, Melvin M. Mosby, Patricia Ellis, Laquita Ortiz and dozens of others wherever you are, if you even exist.

That letter you’ve been waiting for from the California Economic Development Department, possibly containing an unemployment benefit payment, was indeed delivered — just not to you.

It’s been sent to Tom and Andrea Gray, a perplexed, retired Rancho Cucamonga couple who can’t figure out why they keep getting mail from the EDD bearing their address and the names of folks they don’t know.

Since June, their mailbox has been flooded with more than 50 such letters.

The Grays feel like they’ve entered the Twilight Zone and fear criminals may be using their address illegally to obtain COVID-19-related relief benefits. They have been dutifully mailing the unopened letters back to the EDD, but new ones keep arriving.

“Why doesn’t it stop?” Andrea Gray, a 74-year-old former nurse, asked in exasperation.

The Grays’ mail misery began slowly.

The first week they received only a couple of EDD letters, prompting them to dismiss the mail mix-up as a fluke. But the numbers steadily grew. Eight more letters trickled in over the next three weeks. Then a bunch of 10, followed by the mother lode — 16 letters delivered on a single day this week.

“We have never gotten 16 in one day.” said a dismayed Andrea Gray. “They are multiplying like rabbits.”

Tom Gray, a 77-year-old former molding maker, alerted authorities — county, state and federal — to the couple’s plight, but hasn’t received much help.

First, he took the letters to an EDD office in Rancho Cucamonga, but was turned away because staff there only assists job seekers.

His next stop was the San Bernardino County Sheriff’s Department. “They told me to sit in the lobby,” he recalled. “Then they came back out and said the postmaster general is responsible for running the investigation into EDD fraud.”

Gloria Huerta, a spokeswoman for the San Bernardino County Sheriff’s Department, did not immediately have details regarding the encounter with Tom Gray, but said the referral to the U.S. Postal Service was appropriate. “The post office investigates mail fraud,” she said in an email

After visiting the Sheriff’s Department, Tom Gray gathered up his bundle of mail and headed to a Rancho Cucamonga post office, where he was told by employees to mark the letters as undeliverable and drop them in a mailbox.

He and his wife have been painstakingly doing that ever since, but to no avail.

“We write on the letters that the individuals named don’t live here and send them back,” Andrea Gray said, adding that she refuses to open the letters to see if there is a check or debit card inside, both of which can be used to pay claimants. “I don’t care what’s inside. Either people need the money or it’s a bunch of fraud.”

U.S. Postal Inspection Service officials did not respond to emails and phone calls seeking comment.

Nonexistent recipients

It’s unclear whether any of the individuals whose names appear on the EDD envelopes received by the Grays live in California or even exist.

A public records search for 14 edd unemployment login ca supplied by the couple found only two matches for possible California residents. Seven names matched individuals who may reside in Texas, Virginia, Pennsylvania and other states, while public records could not be located for the five remaining names.

Widespread unemployment fraud

Unemployment fraud has been rampant in California since the start of the COVID-19 pandemic in March 2020.

In January, Deputy U.S. Labor Secretary Julie Su said scammers have been paid as much as $31 billion in California unemployment funds. Court dockets are overflowing with cases involving inmates and others who have used fraudulent and stolen identities to receive benefits to which they are not entitled.

EDD officials said Friday in a statement the agency is actively working to stop scammers.

“The EDD is aggressively fighting fraud in the wake of unscrupulous attacks on the unemployment program here in California and across the country,” officials said. “At the EDD, we are dedicated to combating fraudulent activity and protecting benefits for legitimate California workers in need.”

Suspected fraud can be reported by visiting Ask EDD and selecting the “Report Fraud” category to submit a fraud reporting form online. Individuals also can fax 866-340-5484 or call the EDD fraud hotline at 800-229-6297.

Meanwhile, the Grays can’t figure out why their mail carrier keeps bringing stacks of EDD letters to the home in Rancho Cucamonga’s Alta Loma neighborhood they have owned since 1974. “It’s quite obvious that it’s a single-family dwelling and that we don’t have 16 people living here,” Andrea Gray said with a chuckle. “There’s no more room at the inn.”

California Gov. Gavin Newsom's administration on Thursday announced a major chs mankato soybean prices in how the state pays unemployment benefits, potentially unlocking payments for up to 100,000 people who have gone weeks or months without assistance.

Getting unemployment benefits is a two-step process. First, state officials must decide if people are eligible. If they are, the state starts paying them. But those people must contact the state every two weeks to confirm they are still eligible to keep getting edd unemployment login ca, state officials must edd unemployment login ca residents' eligibility after they have been paid. When this happens, the state stops paying them until the investigation is complete. Before the pandemic, these investigations usually did not take long. But during the pandemic, the state has been overwhelmed with millions of claims that have caused lengthy delays.

The Employment Development Department announced Thursday it would keep paying people unemployment benefits even while they edd unemployment login ca investigating their eligibility. The change is part of a lawsuit settlement between the state and the Center for Workers' Rights, an advocacy group.

The change applies only to people who have certified for benefits and have already received at least one week of payment in the past. Daniela Urban, the group's executive director, said it could impact up to 100,000 people.

"This is a monumental change by EDD that will allow more claimants to be paid on time," she said.

The change is not without risk for Newsom, who is facing a recall election in September. "This action today in paying continuing claims that have had previous verifications seems to have low fraud risks, while reducing the backlogs."

It's possible this action will cause the state to pay people who are not eligible. In a news release, the Employment Development Department said people who get benefits when they are not eligible could have to pay those back at some point. But it is possible to waive repayment if people claim financial hardship and the overpayment was not the result of fraud.

State Assemblyman Edd unemployment login ca Patterson, a Republican from Fresno, said the state's action is a "stunning admission that they can't do their fundamental task" of paying legitimate claims while rooting out fraud.

"Now to clear their giant backlog, they're going to take the dangerous risk of paying fraudsters, too," Patterson said. 

Since March 2020, more than 23 million people have filed unemployment claims in California, and the state has paid $160 billion in benefits. Meanwhile, more than 226,000 people are still waiting for the state to resolve their claims and pay them.

They include 57-year-old Abdulkarim Adam, who lost his job as a bus driver for a private company during the pandemic. The state stopped paying him unemployment benefits in March and never told him why, he said. 

Adam had to borrow money from friends and move in with his sons while he waited. He said he called the state every day but could not get through. He was surprised to later receive a text message from the agency, asking for feedback on their customer service. 

Adam said he replied with a flattering message, hoping that would spur the agency to pay him faster. When that didn't work, he later sent an angry message comparing the agency to the authoritarian dictatorship in North Korea. 

He was relieved on Thursday to finally hear about the state's policy change and hoped it would get him his money faster.

"It will ease a lot of financial difficulties, and it will improve our lives," he said.

The Employment Development Department received more than 5.8 million calls from 421,005 unique callers in the final two weeks of June, according to a report posted on the department's website. The department said it answered 478,749 calls during that period.

Urban said many of those calls were from people like Adam wondering why their benefits were halted. She said fewer of those people will likely call now that they know their benefits won't be interrupted.

"I think it will allow claimants to be more confident in relying on the support of these unemployment benefits, while they still have them, as they look for post-pandemic work," she said.

EDD Login Online for UI/SDI

To login to California EDD, you need to follow the below steps.

  • Open this login link on your gadget.
  • On that page, you’ll see two services.
  • One is Employer Services and the second one is Benefit Programs Online.

  • If you’re looking for a job or Unemployment Insurance Benefit or to manage UI claim or SDI Online for Disability Insurance or edd unemployment login ca apply for Paid family leave benefit, click on “Log In or Register” under Benefit Programs Online.
  • Once you tap on it, you’ll again see a new page. Click on “Log in or Register” once again.

For the Employer Services:

  • Visit this page.

To recover the Benefit Programs login password:

  • Go to this link.
  • After typing your email and clicking on login, you’ll see a page to enter your password.
  • There, click on “Forgot Password?” link.

Register new EDD Account Online

As you know, there are two cases here. One is for Employer Services and the second one is for Benefit Programs.

Case #1: Sign up for a Benefit Programs (UI/SDI) Account

  • Foremost, visit the page here.
  • On that page, click on “Register”.
  • You’ll see the Terms and Conditions page.
  • Read them, tick the box and click on “I agree”.
  • Once you get the registration page, enter Email and Password as per instructions.

Is the EDD office open today?

These are instructions to file a new claim (this means you have never filed an unemployment claim, or have not filed a new claim within the last 12 months). If you need to reopen a claim instead, see the Step-by-Step Guide to Reopening a Claim.

Info You Will Need to File a New Claim

  • Your EDD "Benefits Programs Online" account login and password. (If you have never filed before, you will start by creating your account in the next step.)
    • Hopefully you wrote down your account info when you created your account, so it should be a simple matter to log in. (If for some reason you cannot log in and it tells you that your account is locked, you may need to contact the EDD (1-800-300-5616) and try to figure out how to get back in; this may take quite a bit of time).
  • Your gross income for the most recent 18 months, broken down by month, for each employer you worked for.
    • You will need your gross income for each month, starting with July 2019 income. If your December check is issued at the end of December and you are filing before the end of December, you may not have access to your December pay stub, so to estimate what your December gross income wouuld be, simply use your November information.
    • If you taught for multiple intitutions, you will need this info for each employer.
  • Besides the income figures, for each employer, you will need:
    • The number of teaching units you had this semester (or a way to determine your teaching load).
    • The institution's name, address, and phone number.
    • The name and contact number of your immediate supervisor (your dean).
    • The date you first worked for the institution.
    • If you are a member of a union, you will need the union's name, address, phone number, a contact person's name, and the union local number.
  • If you have filed a new claim, or reopened a claim, in the past two years, you will be asked to list the dates you've filed.
  • You may wish to print out this Earnings Worksheet.

If You Have Never Filed a Claim Before, Create Your Account

If you have never previously filed an unemployment claim in California (or if the last time you filed was many years ago, before California changed its online system), you will first need to create your EDD "Benefits Programs Online" account.

If you cannot log in and you get a message that you are "locked out," you have a few options:

  • Wait until the lock disappears (this may take an hour or so).
  • Call the EDD help line at (800) 300-5616 (but it's almost impossible to get through).

File Your Claim

Note: The EDD will log you out after 30 minutes on any page!
The EDD recommends using the latest version of the Chrome or Firefox browser when filing.

Every so often in the process you will see a "Save as Draft" button. Whenever you have the chance you should save a draft, as the last saved draft is what you will have to start with agin if you lose the workflow.

After you have entered all the appropriate information and get to the bottom of each screen, click "Next" or "Save" to continue.

Millions of Californians lost work and filed for unemployment since the pandemic began. It's been scary. The worst-unemployment-since-the-Great-Depression kind of scary.

And, like nearly everything else Angelenos are dealing with, the rules for accessing unemployment benefits keep changing.

New programs are being created (and cut and created etc). There have been massive payment delays. And a learning curve. And months of limited-to-no live contact from representatives. And phones that went unanswered. And the waiting, and the waiting, and the waiting, and the waiting.

The process of acquiring and maintaining unemployment benefits can be its own special hell. The system can be absurdly difficult to navigate. And if something goes wrong, or a step gets overlooked, it's been nearly impossible to speak to an actual human person and get it resolved quickly.

So we put together this guide to help people find the steps a little easier, and hopefully minimize some delays in getting paid.

At the end of September, more than 1.5 million Californians were waiting for their unemployment checks. In an effort to improve its processes (and speed up payments, and square the backlog, and reduce fraud) the Employment Development Department stopped accepting new claims for a two-week "reset period" that began in September. Filing was fully operational again, as of Oct. 5.

And, after allowing aid to lapse, President Trump did sign a pandemic relief bill on Dec. 27 which will extend federal unemployment benefits to provide $300 per week. However, because of the timing, processing delays are expected.

California's EDD website has some videos and a detailed FAQ (or two, or three) about how to navigate all of this — but you can also ask us your questions directly.

We've answered thousands of messages from readers since the world turned upside down, and an outsized number have been about unemployment.

Nothing about this process is fast or easy, but whether you're filing for the first time, or troubleshooting an existing claim, let us know what you still need answered.

How (And How Much)

Let's start with the endgame.

The best case scenario is getting $450 per week from the state.

But it might be as low as $40.

Possibly you'll get something in between.

In addition to your state benefits, you're also entitled to an extra $300 per week in federal benefits through the Federal Pandemic Unemployment Compensation (FPUC) program — but only through March 14, 2021.

California has yet to announce when it will start delivering the new federal weekly supplement, but payments will be back dated to Dec 26, 2020. All unemployment recipients should be eligible for this federal add-on.

There's essentially a 3-part process for acquiring unemployment payments: Registering, Filing, Certifying.

  • Registering is setting up an account.
  • Filing is providing personal details and work history.
  • Certifying is checking-in every two weeks to say you're still unemployed/eligible.

Note: certifying is very important. If you do not do it, they will stop sending you money.

You can manage the benefit process online, over the phone, via mail, and even with a fax machine. But the Employment Development Department recommends online, if possible.

Applying For The First Time

  • Go to the Benefit Programs portal on the EDD website.
  • Register for an account / Log in.
  • Select "UI Online."
  • Select "File New Claim"
  • You'll need to provide the following details:
    • Name
    • Address
    • Phone number
    • Social Security number
    • California driver license or ID card
    • Citizenship status
    • Your last employer (name, address, phone number)
    • The last date you worked
    • The reason you're not working there now
    • Your gross earnings from the last week you worked
    • Information about all your employers in the past 18 months (contact details, how long you worked there, gross wages, weekly hours, hourly rate, reason for no longer working there, etc).
    • And, if you are a former federal employee, ex-military, non-citizen, or have a pension, there are additional forms and details to submit.

UI Or PUA

Gesundheit.

The Benefit Programs portal handles claims for both regular state Unemployment Insurance (UI) and the new federal Pandemic Unemployment Assistance (PUA).

Don't panic if you're not sure which one you qualify for. You don't get to choose.

Applicants are asked the same set of history and earnings questions, plus new questions to determine eligibility.

The department then figures out which program fits your situation, and your paperwork will be processed accordingly.

EDD officials now have clarified that you do not need to open a new claim if you had a balance on your existing claim before the CARES benefits ran out.

The Self-Employed

The Pandemic Unemployment Assistance (PUA) program was created to provide financial relief for self-employed people and others who wouldn't typically qualify for unemployment.

That can include:

  • Business owners
  • Self-employed workers
  • Gig workers
  • Freelancers
  • Independent contractors
  • People with a limited work history

And others who qualify.

This modification is being supported by the federal PUA program, which Congress originally created in the spring of 2020 as part of the Coronavirus Aid, Relief, and Economic Security (CARES) Act — and later extended in the winter as part of a new COVID relief bill. These pieces of legislation are sometimes referred to as a stimulus package and/or a coronavirus relief package. The knee bone's connected to the... something.

PUA was originally set to run through Dec. 26, but Congress has now extended it. The program will continue taking new applicants until March 14, 2021. And those already on the program will be able to collect benefits until April 5, 2021, as long as they are still under the 50-week limit.

The $600 Hole

Another provision of the CARES Act, the Pandemic Additional Compensation program, originally provided an additional $600 per week to all unemployment recipients.

However, that benefit dried up at the end of July, and Congress waited until late December to extend the federal add-on.

For a brief period of time, many unemployment recipients received an extra $300 per week under an executive order signed by President Donald Trump. The Lost Wages Assistance (LWA) program meant another $300 per week for those:

  • already receiving at least $100 per week in benefits
  • certifying for unemployment due to COVID-19

Payments for the LWA program were processed starting on September 7, and were backdated to July 26.

Those already partially or fully unemployed due to COVID-19 should have automatically received LWA payments, including retroactive benefits. If that's not the case, you'll need to certify and provide time-sensitive information.

Once all federal supplements went away on September 5, Californians reverted to receiving weekly state benefits based solely on past income or wages:

  • $167 - $450 per week if your claim is processed as PUA.
  • $40 - $450 per week if your claim is processed as UI.

Now, the federal supplement is coming back — but at just half the previous level. All unemployment recipients should be eligible for up to 11 weeks of $300 payments under the new COVID relief bill.

In certain cases, you may be entitled to an extra $100 on top of the $300 supplement. This additional weekly payment is reserved only for people with "mixed incomes" who've found themselves shortchanged by the unemployment system due to a loophole in how benefits are calculated.

Long story short, some freelancers with small amounts of W2 employment income in their recent work history are seeing all of their 1099 self-employment income disregarded by the unemployment system. The result is a benefit amount that's much lower than it should be, had their past income been considered in full. More information on that loophole can be found here.

To qualify for the $100 federal mixed-income supplement, you must have reported at least $5,000 in self-employment income during the most recent tax year — AND have been disqualified from the PUA program covering most freelancers. States must opt in to this relief. Whether or not California will participate remains to be seen. Even if California does sign on, it's currently unclear how EDD will verify your past income for eligibility, or when the department will start delivering the benefit. Stay tuned for further guidance on that.

Reasons For Not Working

They can be health reasons or work reasons.

You can file because of:

  • Termination
  • Cut hours
  • Unpaid leave
  • Furlough
  • COVID-19 quarantine
  • COVID-19 symptoms
  • COVID-19 diagnosis
  • COVID-19 diagnosis in a member of your household
  • COVID-19 diagnosis in a member of your household and you are providing care
  • Having to quit your job as a direct result of COVID-19
  • Your place of employment being closed as a direct result of COVID-19
  • Missing/quitting work to be at home with your kids while schools are closed
  • The job you were about to start isn't available now as a direct result of COVID-19
  • Not being able to reach your place of employment as a direct result of COVID-19
  • The pandemic severely limiting your ability to perform your customary work

And others.

Disability And Paid Family Leave

Or maybe you may want to apply for a different program entirely, like:

EDD manages these too, but they're different programs with different pay structures and timeframes. However, some of the eligibility criteria seem to overlap.

If you do decide to apply and you don't get approved, you can then pivot to file an unemployment claim.

Certifying For Benefits

Now back to unemployment. And filing a claim isn't the end of it. There are still critical steps to take so that payments aren't delayed or denied.

There are plenty of places for things to go wrong during this process, but mistakes are frequently made during the "certification" when people aren't sure how to answer the questions.

Keep these things in mind:

  • You must be well enough to work to receive UI benefits.
  • Benefits are paid according to how many days you're able to work.
  • Benefits are cut one-seventh for each day you can't work due to illness or injury.
  • You must be unemployed through no fault of your own.
  • You must be able and available for work.
  • You must be willing to accept suitable work.
  • You're typically required to look for work, but that's been waived for the time being.

You might be scheduled for a phone interview if there are questions about your paperwork. And EDD says that within two weeks of filing a claim, you'll be getting some mail:

How Long Do The Payments Last?

We really want to give you a simple answer, but it's variable.

For PUA, there are up to 46 weeks of available benefits. Those payments can be backdated to February 2, as applicable, and will be available until December 31, 2020.

For UI, you can typically only collect for 26 weeks, but these are not typical times, so now there's something called the Pandemic Emergency Unemployment Compensation (PEUC) which adds another 13 weeks of benefits

And, if you use all your PEUC benefits, you also may qualify for a 20-week FED-ED extension.

If you qualify for either extension it will be applied automatically. PEUC benefits are being handled in phases.

Your Claim Status

Consider this a decoder ring for government-speak.

  • Paid: You met eligibility requirements.
  • Pending:There may be an issue with your certification responses.
  • Disqualified:You are not eligible this week.
  • Excessive Earnings: No benefits because you made more than your weekly benefit amount.
  • False Statement Penalty Week: No benefits this week as a penalty for giving a false statement (for example: you went back to work but didn't tell the EDD and continued to collect benefits).

LOS ANGELES – A former California Employment Development Department (EDD) employee has agreed to plead guilty to a federal criminal charge for causing nearly 200 fraudulent COVID-related unemployment relief claims to be filed in other people’s names, resulting in more than $1.6 million in ill-gotten gains, the Justice Department announced today.

          Gabriela Llerenas, a.k.a. “Maria G. Sandoval,” 49, of Perris, signed a plea agreement that was filed today in which she has agreed to plead guilty to a single-count information charging her with mail fraud.

          Court records show that Llerenas previously worked at EDD as a disability insurance program representative. She resigned in March 2002 after admitting to fraudulently authorizing and paying disability benefits administered by EDD. She was sentenced to 37 months in federal prison in connection with that scheme.

          The new scheme that Llerenas has admitted running took advantage of the expanded eligibility for unemployment insurance (UI) benefits made possible by the Coronavirus Aid, Relief, and Economic Security (CARES) Act passed by Congress and signed into law in March 2020. The CARES Act provided additional UI benefits to qualified individuals and helped provide UI benefits during the COVID-19 pandemic to people who did not otherwise qualify, including business owners, self-employed workers, independent contractors, and those with a limited work history.

          From April to October 2020, Llerenas filed and caused the filing with EDD of fraudulent unemployment insurance benefits that falsely asserted the named claimants were self-employed independent contractors – often identifying them as cake decorators or event attendants – who were negatively affected by the COVID-19 pandemic. Llerenas obtained some of the names, Social Security numbers and other identifying information she used to submit the fraudulent claims through her prior work as a tax preparer.

          In her plea agreement, Llerenas also admitted to falsely stating on some of the applications that the claimants were residents of California entitled to unemployment insurance benefits administered by EDD when in fact they lived elsewhere. She also admitted that, on some applications, she inflated the amounts of income she reported for the claimant to maximize the benefit amount. She also admitted to sometimes filing a dozen or more fraudulent EDD claims in a day.

          As a result of the fraudulent unemployment benefits applications that Llerenas filed and caused to be filed, EDD authorized Bank of America to mail debit cards in the names of the claimants to addresses she provided, including her residence, her husband’s business location, her mother’s apartment and the addresses of friends and other family members.

          Llerenas admitted that she charged the named claimants a fee for filling the applications, which was often paid out of the fraudulently obtained benefits. In at least one case, she told the named claimant that she was still employed at EDD and could control the distribution of the unemployment insurance benefits, and then demanded an additional payment for “releasing” the benefits.

          In total, 197 debit cards were fraudulently issued because of this scheme, resulting in losses to EDD and the United States Treasury that Llerenas has admitted were at least $1,633,487.

          Llerenas is scheduled to make her initial appearance on September 22. The criminal offense to which Llerenas has agreed to plead guilty carries a statutory maximum sentence of 20 years in federal prison.

          The Department of Labor-Office of Inspector General, EDD-Investigations Division, Homeland Security Investigations, United States Postal Inspection Service, Federal Bureau of Investigation and Social Security Administration-Office of Inspector General investigated this matter.

          Assistant United States Attorney Ranee A. Katzenstein, Chief of the Major Frauds Section, is prosecuting this case.

          On May 17, 2021, the Attorney General established the COVID-19 Fraud Enforcement Task Force to marshal the resources of the Department of Justice in partnership with agencies across government to enhance efforts to combat and prevent pandemic-related fraud.

          The Task Force bolsters efforts to investigate and prosecute the most culpable domestic and international criminal actors and assists agencies tasked with administering relief programs to prevent fraud by, among other methods, augmenting and incorporating existing coordination mechanisms, identifying resources and techniques to uncover fraudulent actors and their schemes, and sharing and harnessing information and insights gained from prior enforcement efforts. Employment Development Department

In California, the Employment Development Department (EDD) is a department of government that administers the Unemployment Insurance (UI), Disability Insurance (DI), and Paid Family Leave (PFL) programs. The department also provides employment service programs and collects the state's labor market information and employment data. The department is one of California's three major taxation agencies, alongside California Department of Tax and Fee Administration and the Franchise Tax Board; in addition to collecting unemployment insurance taxes, the Department administers the reporting, collection, and enforcement of the state's personal income taxes.[2]

History[edit]

The Legislature created the Department of Employment as part of the Unemployment Reserves Act in 1935. The act (Statutes 1935, chapter 352) was set up to provide "a (monetary) reserve to assist in protecting the public against the social effects of unemployment." The purpose of the department was to operate a statewide system of employment agencies and distribute the payment of unemployment insurance to eligible unemployed workers.[citation needed]

The employment agencies were an existing legacy program launched by the Legislature in 1915 to match unemployed job seekers with employers; they were briefly part of the Department of Industrial Relations (created in 1927) before the Department of Employment was created.[citation needed]

As part of Governor Reagan's Reorganization Plan of 1968, the Department of Employment was placed under the Human Relations Agency. With the signing of chapter 1460 that same year, the department became the Department of Human Resources Development, which assumed the duties, purposes, responsibility, and jurisdiction of the former department. The name of the department was again changed in 1974 (chapter 1212), when it became the Employment Development Department.[3]

The Administration Branch provides administrative support to the Department, including providing business operations planning and support services, human resource services for EDD employees, and accounting for the Department's annual budget.[4]

The Disability Insurance Branch has over 1,200 employees organized into a Central Office; a Field Operations Division (with Claims Management Offices and Customer Service Centers); and an Office of the Medical Director.[5] The Branch administers the State Disability Insurance program (which includes Disability Insurance and Paid Family Leave), as well as Non-Industrial Disability Insurance. Among other initiatives, by 2011 the Branch plans to implement a Disability Insurance Automation project for more efficient and effective electronic communications and information processing.[5][6] The state's legal and regulatory requirements for the Branch's programs are found in the California Unemployment Insurance Code, the California Labor Code, and Title 22 of the California Code of Regulations.[7]

The Information Technology Branch is responsible for automation planning, policy, development, maintenance, support, operations, and oversight of automation systems within the Department.[4] The branch provides data processing technical support and services for one of the largest information technology environments in State government, including the planning, development, maintenance, installation, and support of telecommunications systems such as cabling, voice, and data equipment.

The Policy, Accountability, and Compliance Branch performs review oversight and technical assistance functions for the Director, EDD's executive staff, and state and local EDD program management.[4] The Branch is responsible for fraud detection and deterrence "through sound internal control structures, internal and external audits, risk assessments, detailed Quality Control reviews, and criminal investigations".[8]

The Public Affairs Branch provides outreach, marketing services, communications, and training that support EDD programs[4] and the employment of special targeted populations. The branch is composed of the Marketing and Constituent Services Office, the Communications Office and the Web Content and Usability Group.

The Tax Branch, one of the largest tax collection agencies in the nation, handles all administrative, education, customer service, and enforcement functions for the audit and collection of Unemployment Insurance Tax, Employment Training Tax, State Disability Insurance Tax, and Personal Income Tax withholding.[4] Unemployment Insurance Tax and Employment Training Tax are employer contributions, while State Disability Insurance Tax and Personal Income Tax are withheld from employees' wages.[9] Each year, EDD collects more than $85 billion in payroll taxes, including nearly $71 billion in Personal Income Tax, processes more than 50 million employer payroll tax documents and remittances, and maintains records for more than 19 million workers.[citation needed]

The Workforce Services Branch includes several major programs. The Branch administers the federal Worker Adjustment and Retraining Notification Act (WARN Act) and the California law that expands upon the WARN Act.[10]

Joseph Wood went to buy gas in Ventura in anticipation of driving up the coast to visit his children this week. The 39-year-old gig driver knew he had money on a debit card connected to his unemployment payments when his purchase was declined.

Unable to fill up his tank, he found his card was frozen. By the time it unlocked Monday, $1,380 had disappeared.

In what appears to be the latest problem at the besieged state Employment Development Department, unemployed Californians say their accounts are being erroneously frozen, leaving them unable to access a financial lifeline amid the pandemic. Reports surfaced last week and continued over the weekend with beneficiaries reporting their Bank of America accounts — where benefits are deposited and spent — frozen, closed or drained of money.

Amid a backlog of 1.6 million unprocessed claims, angry lawmakers and out-of-work residents, California’s unemployment agency placed a two-week pause on new claims to implement an automatic identity-verification tool to speed up processing times. The move was among a list of recommendations from Gov. Gavin Newsom’s strike team to improve call center service and outdated technology. To date, more than 13 million claims have been filed and the agency has doled out about $94 billion in benefits.

Now as the department resumes full operation with a new identity verification system, a new issue has emerged: people can’t get their money out.

The $1,380 that disappeared for Wood looked familiar. It’s the same amount he lost to a Burbank fraudster and then had returned by EDD this summer.

Over the weekend, he shuttled back and forth between the department and Bank of America, the bank contracted by the state to issue debit cards, each side deferring to the other about the freeze and the disappearing cash — labeled “Dispute Adjustment.” Wood uploaded more documents to reverify his identity, but the money is still missing, and he can’t get clarity from either group.

“I’m incredibly frustrated,” he said. “I was supposed to go up and pick up my kids on Monday, but I couldn’t.”

Freeze first, verify second

The department seems to be freezing accounts first and asking questions second.

The state stated that extra steps were necessary to vet claims amid reports of fraud. But legitimate claimants appear to be caught up in the verification process, leaving them with few answers and no way to access money already dispersed to them.

One Sacramento TV station, KCRA, obtained a script that some EDD employees were given to help answer questions about the situation. It tells callers that they will receive an email, text, or notice in the mail within five to seven days of their account being frozen.

The agency told lawmakers at a committee hearing Wednesday that in an effort to weed out fraudsters, it is working with Bank of America to review some 358,000 debit cards issued to unemployed Californians, and is also looking into 315,000 unpaid unemployment claims.

The EDD told CalMatters that all these claims have been temporarily suspended because of an unusually high volume of claims from single addresses, adding that recipients had been notified in the past few weeks that they would need to reverify. This does not align with their stories of sudden, unexplained account freezes.

EDD Director Sharon Hilliard also said at the hearing that the agency’s 27 fraud investigators currently have 75 open cases. When pressed by lawmakers on how much taxpayer money may have been lost to unemployment fraud during the pandemic, Hilliard said the agency does not have an estimate.

“It’s going to be in the hundreds of millions,” Sacramento Democratic Assemblymember Jim Cooper said during the hearing. In the meantime, much of the burden for investigating EDD debit card fraud has fallen to local law enforcement.

Beverly Hills Assistant Chief of Police Marc Coopwood told lawmakers his investigators have arrested over 100 people for EDD fraud and confiscated 200 EDD debit cards. “We will not arrest our way out of this problem,” Coopwood said. “We need to see systematic changes at EDD.”

To complicate matters, President Trump on Tuesday tweeted ending talks with congressional Democrats on another coronavirus stimulus package before the election. He later tweeted he would support funding stimulus checks, small businesses and airlines. Without additional aid to state and local governments as well as the unemployed, it dashed hopes of extending a $600 weekly federal boost that expired in July. 

Money missing with no warning

Jesika, whose last name is not being published for worries about finding a new job, has been receiving Pandemic Unemployment Assistance — the benefits aimed at contract and gig workers — sporadically throughout the year. The Glendale resident checked the balance in her account on Thursday: around $1,500. The next day, she started seeing Facebook posts about cards being locked, and she tried to check her account again.

It was frozen. 

A series of weekend calls did nothing to clear things up. Bank of America first told Jesika the state had closed her account due to fraud, then told her all they could see was a freeze. One EDD representative told her she must have mistyped her password multiple times. Another told her she needed to reverify her identity. A third said her account had been frozen because of a flag.

She was frustrated that her money could be blocked with no warning. 

“I get where they have to verify,” Jesika said. “Send a text message and say, ‘Hey,’ or an email, ‘You have 10 days to comply or your ATM card is going to get blocked.’ What if I had no other cash or means for the weekend?”

The professional caregiver, who has lost her car and is now on the brink of bankruptcy, has struggled with the EDD for months. Rarely do the benefits come easy; she says it feels like her new job is trying to reach the department over the phone. 

After a weekend of calls and scanning old documents to reverify her identity, the account did reopen and Jesika was able to make withdraws Monday. 

“I feel like their little puppet,” she said.

Hilliard said that the federal government’s unprecedented Pandemic Unemployment Assistance program for out-of-work contract workers “opened the door for fraud in a way it never has before,” because of fewer “checks and balances” than traditional unemployment insurance.

Schemes to defraud the system and identity theft have bloomed across the state. These are not victimless crimes, Jessica Bartholow of the Western Center on Law and Poverty points out — Californians whose identities are used by scammers can be blocked from their own deserved benefits.

At the same time, the freezing of accounts seems to fly in the face of a recommendation in the strike team’s report: the agency shouldn’t allow anti-fraud practices to prevent timely access to benefits.

Bartholow said that even if funds aren’t available for a few days, payment fees and overdraft charges can stack up, on top of the stresses for unemployed Californians looking to access their money.

“There are monetary costs,” Bartholow said, “and there are real and tangible harmful impacts to people.”

Hilliard told lawmakers today that she is “very confident” EDD will clear its 1.6 million-claim backlog by January, and that the agency has taken action on about half of the governor’s strike team’s recommendations.
